NOTICE OF SALE
Default has been made in the condition of certain mortgage made the 3rd day of December, 2005, by James E. Browning and Kathryn A Browning, to Northwestern Bank and recorded on December 9, 2005 in the office of the Register of Deeds for Leelanau County, Michigan, at Liber 884, page 86, on which mortgage there is claimed to be due and unpaid at the date of this Notice ONE HUNDRED SIXTY-THREE THOUSAND FIVE HUNDRED TWENTY-ONE AND 40/100 DOLLARS ($163,521.40) and no suit or proceeding at law or in equity has been instituted to recover the debt, or any part of the debt, secured by said mortgage, and the power of sale contained in said mortgage has become operative by reason of such default.
NOTICE IS HEREBY GIVEN that on Friday, March 26, 2010 at 11:00 o’clock in the forenoon, at the Courthouse, 8527 Government Center Dr., Suttons Bay, Michigan 49682, there will be offered for sale and sold to the highest bidder, at public sale, for the purpose of satisfying the amounts due and unpaid upon said mortgage, together with legal costs and charges of sale, including an attorney fee of Seventy-Five ($75.00) Dollars provided by law and in said mortgage, the lands and premises in said mortgage mentioned and described as follows, to wit:
Part of the Northwest 1/4 of the Northwest 1/4 of Section 27, Town 31 North Range 11 West, beginning at the Northwest corner of Section 27; thence South 89°54’28” East along the North Section line 536.22 feet; thence South 20°30’15” West, 597.39 feet; thence North 48°39’58” West, 138.59 feet; thence North 79°42’53” West, 82.7 feet; thence South 67°19’55” West, 153.63 feet; thence North 00°03’55” East, 513.28 feet to the Point of Beginning.
An easement for ingress, egress, construction and maintenance of public utilities on, over, and across part of the West 1/2 of Section 27, Town 31 North, Range 11 West, Leelanau Township, Leelanau County, Michigan, being 20 feet wide, 10 feet either and both sides of a line described as: Commencing at the center of Section 27; thence North 00°00’27” West, 458.93 feet to the Point of Beginning; thence South 89°45’35” West, 389.18 feet; thence North 09°48’20” East, 216.70 feet; thence North 17°00’58” West, 659.59 feet; thence North 45°03’21” West, 705.08 feet; thence South 88°13’35” West, 372.04 feet; thence North 57°28’09” West, 628.24 feet, to the Point of Beginning.
Situated in Leelanau Township, County of Leelanau, State of Michigan.
The redemption period shall be one (1) year from date of sale; provided, however, that if the subject premises are heretofore or hereafter conclusively presumed to have been abandoned pursuant to MCL 600.3241a, the applicable period for redemption shall be thirty (30) days from said date, or otherwise shortened, in accordance with that statute.
