Notice Of Mortgage Foreclosure Sale

MORTGAGE SALE - Default has been made in the conditions of a mortgage made by Alex D. Misico, a married man, original mortgagor(s), to Mortgage Electronic Registration Systems, Inc., as nominee for lender and lender’s successors and/or assigns, Mortgagee, dated March 29, 2006, and recorded on April 13, 2006 in Liber 897 on Page 316, in Leelanau county records, Michigan, and assigned by said Mortgagee to BAC Home Loans Servicing, L.P. as assignee, on which mortgage there is claimed to be due at the date hereof the sum of Two Million Three Hundred Eleven Thousand Five Hundred Eighty-Nine And 40/100 Dollars ($2,311,589.40), including interest at 8.875% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue, at the place of holding the circuit court within Leelanau County, at 11:00 AM, on February 26, 2010.
Said premises are situated in Township of Leland, Leelanau County, Michigan, and are described as: Part of Government Lot 1, Section 27, Town 31 North, Range 12 West; Commencing at a point which is 939.79 feet North of and 151.73 feet East of the meander corner at the intersection of the South line of said Section 27 and the Westerly shore of Lake Leelanau; thence North 61 degrees 32 minutes 00 seconds East 150.06 feet to the point of beginning; thence North 29 degrees 56 minutes 00 seconds West 313.25 feet to the shore of Lake Michigan; thence along said shoreline North 60 degrees 04 minutes 00 seconds East, 175.62 feet; thence South 24 degrees 05 minutes 20 seconds East, 323.53 feet; thence South 82 degrees 57 minutes 00 seconds West, 13.60 feet; thence South 61 degrees 32 minutes 00 seconds West, 130.25 feet to the point of beginning of this description, including all land lying between the waterfront course of the above described parcel and the high water mark of Lake Michigan.
Together with a non-exclusive 20.00-foot access easement running from State Highway M-22 to the above described parcel over an existing road known as Sugarbush Lane, more fully set forth in Liber 68, Page 650.
The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale.
